Terms & Conditions

These Terms & Conditions apply to bookings and services provided by Nomad Adventures Limited trading as Nomad Safaris.

1. Booking Confirmation & Payment

Prepayment by credit card (Visa, Mastercard, UnionPay, JCB) and subsequent email confirmation by Nomad Adventures Limited constitutes confirmation of your booking.

All prices and transactions are in New Zealand Dollars (NZD). Due to exchange rate fluctuations, there may be some variance between the amount originally charged and any amount refunded. Nomad Adventures Limited accepts no responsibility for exchange rate fluctuations or any resulting credit card or bank charges.

The name appearing on your credit card or bank statement will be Nomad Adventures Limited.

2. Pick-ups & Drop-offs

Nomad Safaris 4WD tours include pick-up and drop-off from central Queenstown hotels.

Pick-ups from Millbrook, Hilton, Jacks Point and other locations outside central Queenstown may be available for groups on request and may be subject to additional conditions or charges.

3. Privacy & Confidentiality

All personal information provided to Nomad Adventures Limited will be treated confidentially and handled in accordance with applicable New Zealand privacy legislation.

Information will only be shared where necessary to fulfil your booking, provide the services requested, or where required or permitted by law. In an emergency, information may be provided to appropriate authorities, including Police, emergency services or search and rescue organisations where necessary.

4. Minimum Numbers

A minimum of 2 paying adult-rate passengers is required to confirm all trips.

On New Zealand statutory holidays, a minimum of 4 paying adult-rate passengers applies to all trips.

Where a single passenger is the only person booked to travel on a particular departure, Nomad Adventures Limited reserves the right to suggest an alternative date or departure.

5. Cancellation by the Customer

Bookings cancelled more than 24 hours before departure will incur no cancellation fee.

Bookings cancelled within 24 hours of departure will be subject to a 100% cancellation fee.

Customers who fail to arrive for their scheduled departure (“no-shows”) will not be entitled to a refund.

Large group bookings of 10 or more passengers cancelled within 72 hours of departure are non-refundable.

Refunds will only be issued through the original booking office.

6. Cancellation or Changes by Nomad Safaris

Nomad Adventures Limited reserves the right to cancel, postpone, alter or partially cancel any scheduled departure due to weather, road, river or other conditions, operational requirements, safety considerations, force majeure or other circumstances outside its reasonable control.

Nomad Adventures Limited also reserves the right to decline to accept or retain any person as a member of a tour where it considers this necessary for safety, operational or other reasonable considerations.

Customers will be advised as soon as reasonably possible of any cancellation or part cancellation.

Where Nomad Safaris cancels a tour or part of a tour, customers will be offered the option to reschedule or receive a full refund, or a refund for the affected portion of the trip where only part of the service is unable to be completed.

Nomad Adventures Limited will not be liable for any additional costs, losses or expenses incurred as a result of a cancellation, alteration or delay outside its reasonable control.

7. Weather, Road & Operational Conditions

All tours operate subject to weather, road, river and other environmental and operational conditions.

The safety of passengers, guides and staff is the primary consideration when determining whether a tour can operate.

Nomad Safaris reserves the right to delay, cancel, modify, shorten or alter a tour or route where conditions are considered unsuitable or unsafe.

Guides and drivers may modify routes or shorten a tour where conditions unexpectedly change.

8. Lost Property

Nomad Adventures Limited accepts no responsibility for loss of or damage to passengers’ personal property while travelling on any tour or while property is left in or around any vehicle or facility operated by Nomad Safaris.

Passengers are responsible for their own belongings.

9. Limitation of Liability

To the fullest extent permitted by law, Nomad Adventures Limited accepts no liability for any act or omission arising from a tour, including any loss, damage, delay, expense or inconvenience arising from a tour being altered, delayed, cancelled or not taking place.

To the extent permitted by law, passengers release and hold harmless Nomad Adventures Limited, its officers and employees from claims, losses, damages or expenses arising during or in connection with a tour.

Nomad Adventures Limited does not accept liability for the acts, omissions or default, whether negligent or otherwise, of third-party companies or persons providing services in connection with a tour.

Without limiting the above, Nomad Adventures Limited is not liable for any inaccuracy, misdescription or change to any tour, itinerary, service or facility provided by Nomad Adventures Limited or any third party.

Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited.

10. Indemnity

To the fullest extent permitted by law, passengers indemnify Nomad Adventures Limited, its officers and employees against claims, losses, damages or expenses arising from the passenger’s acts or omissions in connection with a tour.

This includes reasonable legal costs incurred in defending any such claim, to the extent permitted by law.

11. Force Majeure / Circumstances Beyond Our Control

Nomad Adventures Limited is not responsible for losses, delays or additional expenses incurred by passengers as a result of circumstances beyond its reasonable control, including sickness, adverse weather, road closures, strikes, delays, changes to air or other transport services, natural disasters, acts of God, government restrictions or other force majeure events.

12. Prices & Rates

All prices are in New Zealand dollars (NZD) and include GST unless otherwise stated.

Rates are subject to change where circumstances outside Nomad Adventures Limited’s reasonable control affect the cost of providing the service.

Published rates and rate sheets do not constitute a contract until a booking has been confirmed and accepted by Nomad Adventures Limited.

13. Passenger Categories

For pricing purposes:

Infants: 0–4 years — travel free.

Children: 5–14 years.

Adults: 15 years and over.

14. Statutory Protections – New Zealand Law

These Terms & Conditions are governed by New Zealand law.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies available to consumers under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, or any other applicable New Zealand legislation.

Where any provision of these Terms & Conditions is inconsistent with a mandatory statutory right or obligation, that statutory right or obligation will prevail.
